The following is a review of one of Scott J. Corwin’s actual motorcycle accident cases, which was caused by an automobile driver’s negligence. While all cases are unique and results vary, we’re sharing the specific circumstances and results of this case to provide an idea of how a skilled motorcycle accident lawyer might help you secure similar compensation.
It is especially important to hire a competent attorney to represent your interests after you are injured while riding a motorcycle. Far too often, motorcyclists are blamed for crashes in which they were actually the victim.
Motorcycle Accident Case Summary
The injured motorcyclist in this case was James D., a 23-year-old University of Southern California student at the time. James was riding his Suzuki motorcycle northbound on the Pacific Coast Highway when he entered the intersection at Madison Street in Torrance, California. At the same time, the driver of a Toyota Solara went through a yellow light and made a left turn in front of James. He was thrown off his motorcycle and launched over the Toyota to land near a crosswalk.
James secured the services of Scott J. Corwin and alleged that defendant was negligent in the operation of her vehicle and that all of his injuries were a direct result of said negligence. The Toyota’s driver initially disputed liability, but later accepted blame. However, the defendant disputed the nature and extent of James’s claimed injuries.
Not surprisingly, given how exposed motorcycle riders are, James’s resulting injuries were extensive. His left knee was dislocated and he suffered ACL, PCL, medial and lateral meniscus tears. He additionally suffered a serious left elbow fracture. James required multiple surgical procedures on his elbow and knee, including open reduction internal fixation using pins, plates, and screws for his elbow and arthroscopic partial medial meniscectomy and debridement, then a second arthroscopy on his knee. At the time, James was told he would require at least three more surgical procedures on his left knee over time: a left knee ACL allograft repair and two total knee replacements. He was also told he would require a future left elbow surgery to remove the hardware implanted to repair the extensive damage. Medical professionals warned that he might have permanent nerve damage in his left knee and leg.
Although the Toyota driver disputed liability, Scott Corwin was able to clearly demonstrate that the driver was negligent in going through the yellow light and striking James, and that all of his injuries were directly caused by the defendant’s negligent and avoidable actions. Because the facts were on this young rider’s side, and he had the right attorney to prove his claims, James received an insurance settlement of $1,250,000 to cover his current and future medical bills, pain and suffering, and other damages.
